Terms of Service for Deuce

These Terms of Service ("Terms") govern your access to and use of the Deuce mobile application and related services (collectively, the "Service"). The Service is operated by [LEGAL ENTITY NAME] ("Deuce," "we," "us," "our").
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) The Service
Deuce is a social sports app that helps users discover tennis courts, find and connect with other players, organize games, join communities, create events, message other users, and share content.
The Service is available on iOS and Android.
2) Eligibility
You must be at least 13 years old to use the Service.
If you are under 18, you may use the Service only with the consent of a parent or legal guardian, and they are responsible for your use.
You may not use the Service if you are prohibited by law from using it.
3) Accounts and Security
To use certain features, you must create an account. You agree to:
- Provide accurate, current information
- Maintain and promptly update your information
- Keep your login credentials secure
- Accept responsibility for all activity on your account
We may require verification or additional information to maintain account integrity.
4) Real-World Activities and Safety
Deuce facilitates coordination of in-person activities (games, events, meetups). You understand and agree:
- We do not conduct background checks or identity verification on users.
- We do not supervise or control in-person meetups, and we are not responsible for what happens during them.
- Sports and in-person meetups involve risks (injury, illness, theft, property damage, harassment, and other harms).
- You are solely responsible for your decisions and interactions, including where you meet, who you meet, and whether you participate.
Use good judgment. Meet in public places, tell a friend where you're going, and contact local emergency services if you feel unsafe.
5) Acceptable Use
You agree not to:
- Break any law or regulation
- Harass, threaten, stalk, or harm others
- Discriminate or use hate speech
- Post or send spam, scams, or misleading information
- Impersonate others or misrepresent affiliation
- Share content you do not have rights to share
- Attempt to bypass security, access accounts you don't own, or interfere with the Service
- Use the Service to collect personal data about other users without consent
We may investigate violations and take action, including removing content and restricting access.
6) User Content
"User Content" includes anything you post or submit through the Service, such as profile information, photos, posts, messages, comments, match results, events, and other materials.
Ownership
You retain ownership of your User Content.
License to Deuce
You grant Deuce a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, use, reproduce, modify (for technical formatting), display, distribute, and make available your User Content for the purpose of operating, providing, improving, and promoting the Service.
This license ends when your User Content is deleted from the Service, except to the extent:
- content has been shared with others and they have not deleted it,
- content is retained in anonymized form (see Section 10),
- content remains in backups for a limited period, or
- we must retain it for legal, safety, or security reasons.
Responsibility for User Content
You are responsible for your User Content and represent that you have all necessary rights to submit it.
7) Messaging
The Service includes direct messages and group/community chat. Messages may be stored and processed by third-party providers used to deliver chat functionality.
You agree not to use messaging features to harass others, send illegal content, or violate these Terms.
8) Reporting and Blocking
Deuce provides tools to report users and content and to block other users. We may review reports and take action we deem appropriate.
We are not obligated to monitor or pre-screen content, but we may do so and may remove or restrict content at any time.
9) Third-Party Services
The Service relies on third-party services (e.g., authentication, messaging, maps, storage, push notifications). Your use of those features may be subject to the third parties' terms and policies. Deuce is not responsible for third-party services.
10) Account Deletion and Data Handling
You may delete your account in the app via Settings > Delete Account.
When you delete your account, Deuce applies a soft-delete and anonymization process. For example:
- Your profile may be anonymized (e.g., "Deleted User") and your email replaced with a placeholder
- Some content may be deleted (e.g., bookmarks, notifications, push tokens, preferences, feedback)
- Messages and game-related messages may be anonymized (e.g., replaced with "[Message from deleted user]") rather than fully deleted
- Some historical records may remain (e.g., game history and match results) in anonymized form
- Communities you created may be transferred to another member or administrator
We may retain limited information as required for legal compliance, safety, security, fraud prevention, dispute resolution, and backup integrity.
11) Intellectual Property
The Service, including its software, designs, text, graphics, logos, and other original content (excluding User Content), is owned by Deuce and protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Service except as permitted by law.
12) Feedback
If you submit suggestions or feedback, you grant Deuce the right to use it without restriction or compensation.
13) Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEUCE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee:
- that courts, locations, schedules, or user information are accurate
- that the Service will be uninterrupted, secure, or error-free
- that users will behave appropriately
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEUCE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT WILL DEUCE'S TOTAL LIABILITY EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO DEUCE (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not allow certain limitations, so some limits may not apply to you.
15) Indemnification
You agree to defend, indemnify, and hold harmless Deuce and its officers, directors, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- your use of the Service,
- your User Content,
- your interactions with other users, including in-person activities,
- your violation of these Terms or applicable law.
16) Suspension and Termination
We may suspend or terminate your access to the Service at any time if we believe you violated these Terms, created risk or legal exposure, or misused the Service.
You may stop using the Service at any time. Account deletion is available in the app.
17) Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., in-app notice). Continued use after changes means you accept the updated Terms.
18) Governing Law and Venue
These Terms are governed by the laws of [STATE / JURISDICTION], without regard to conflict-of-laws rules.
Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in [COUNTY, STATE], and you consent to their jurisdiction.
19) Miscellaneous
Entire Agreement
These Terms (and the Privacy Policy) are the entire agreement between you and Deuce regarding the Service.
Severability
If any provision is unenforceable, the rest remains in effect.
No Waiver
Failure to enforce a provision is not a waiver.
Assignment
You may not assign these Terms without our consent; we may assign them as part of a business transfer.
Survival
Sections that by their nature should survive termination will survive (including IP, disclaimers, limitation of liability, indemnity, disputes).
20) Privacy
Your use of the Service is also governed by our Privacy Policy.
